Whistleblower Law

As stated under the False Claims Act, which is considered by some as Whistleblower Law;

“Any employee who is discharged, demoted, suspended, threatened, harassed, or in any other manner discriminated against in the terms and conditions of employment by his or her employer because of lawful acts done by the employee on behalf of his employer or others in furtherance of an action under this section, including investigation for, initiation of, testimony for, or assistance in an action filed or to be filed under this section, shall be entitled to all relief necessary to make the employee whole.”

Thus, any employee, who has disclosed an illegal act of his/her employer or testified against his/her company, is guaranteed protection against any form of retaliatory conducts.

Here are some of the legal remedies that may be entitled for the whistleblowers:

  • job reinstatement in a similar or much higher post

  • double back pay

  • special damages resulting from the discriminatory acts by the employer

  • interest

  • legal cost

To have better opportunity of winning a whistleblower claim, an employee must:

  • exercised any action protected under the Whistleblower Law

  • establish in court his/her assistance in an investigation, prosecution or actions initiated by the government

  • prove that the termination or discrimination are retaliatory in nature

Many states in the U.S. also have their own law provisions that give protection to the whistleblowers. These statutes further elucidate the rights of employees against retaliation.
