EMPLOYMENT LAW: The Scooter Store Faces Suit after Firing a Disabled Worker

New York- The Scooter Store Incorporated in Farmingdale is facing a disability discrimination lawsuit after refusing to grant leave request and firing a disabled worker, according to US Equal Employment Opportunity Commission (EEOC) reports on Friday.
Reports said an employee at the Scooter Store filed a temporary leave of absence, with medical documentation, for his knee injury.However, the employer allegedly rejected his request and fired him for job abandonment.
The aggrieved employee reported the misconduct to EEOC, narrating how the employer failed to provide him with reasonable accomodation though he informed the company about his condition ahead of time.
In his request, he stated that his psoriatic arthritis after a knee injury requires medical attention. He also explained that granting such request will not cause undue hardship for the company, reports said.
Reports said EEOC filed the disability discrimination lawsuit in US District Court for the Eastern District of New York after initiating a conciliation process. The federal agency is seeking unspecified damages on behalf of the aggrieved employee.
