EMPLOYMENT DISCRIMINATION: Oakhurst McDonald’s Owner Charged with Disability Discrimination

September 14, 2011

Fresno - The US Equal Employment Opportunity Commission (EEOC) has filed a disability discrimination suit against Alia Corporation, owner of a McDonald’s in Oakhurst for unfair treatment of a supervisor with cerebral palsy, an official statement released in its website said.

According to the statement, the victim, identified as Derrick Morgan, had worked with the company before he was forced to quit. Records showed he was known as a good employee and even promoted from crew member to floor supervisor. But when Alia Corporation assumed control of the restaurant in Oakhurst, Morgan was demoted to janitorial position and his wages was reduced. He was later forced to quit his job due to the reduction of his income.

The EEOC filed the lawsuit against Alia in US District Court of Eastern District of California after a pre-litigation settlement failed. The lawsuit seeks back and compensatory and punitive damages on behalf of Morgan, including injunctive relief to prevent further violation.
