EMPLOYMENT DISCRIMINATION: Nebraska Living Facility Settles EEOC Disability Discrimination Suit

Lincoln, Nebraska – A city-assisted living facility has agreed to settle a disability discrimination lawsuit filed by the US Equal Employment Opportunity Commission (EEOC) in June 2010, the federal agency press statement said.

According to the EEOC lawsuit Haven Manor, Inc. violated the Americans with Disabilities Act (ADA) when it refused to accept the temporary placement of Amanda Huff, a hearing-impaired certified nursing assistant at its Lincoln facility.

In the consent decree submitted by Haven Manor, the company agreed to pay Huff with $10,000 in settlement of the EEOC claim. It also agreed to provide training to its management and supervisory employees on disability discrimination and reasonable accommodation.

In addition to this, the company has also agreed to provide the federal agency with reports of every request for reasonable accommodation made by employees for three years.
