Minimum Wage Claim

As required by the law, employees in California must receive a standard payment of $8.00 per hour of work as of January 1, 2008 with exemptions to those who are working as outside salesperson, parents, spouse or child of the employer and apprentices. Exemptions to minimum wage law also cover the following individuals and facilities:

  • Learners – regardless of their age, learners may be employed on a lower rate but not less than 85% of the regular pay during their first 160 hours of work, if they have no similar experience on their present tasks.

  • Mentally or physically disabled persons – disabled workers may receive lower payments provided that their employer have been issued special license by the Division of Labor Standards Enforcement. Such license must indicate that the company was able to qualify according to the standards of the Labor Code Sections 1191 and 1191.5.

Minimum wage is an obligation of the employers. Hence, there are no reasons for them not to abide by the law. They may not also compel their employees to sign any contract that indicates their employees’ consent for lesser pay. Adults, as well as qualified minors are also covered by this provision.
