Litigation Planning Strategy: Are Litigation Budgets Necessary?


In recent years, several high-profile cases demonstrated the worth of not being well prepared for litigation. Hence, it should be known by all that, preparation is the vital element of a successful litigation and that strategy planning for litigation is the most important part of preparation.

The litigation planning strategy involves more than being up to date and being informed about what is happening and how much is the costing. It must as well set the goals of the parties to promptly and effectively solve the disputes, and that the litigation expenses must be as low as possible.

Every company wants to control and lessen litigation costs. However, this is indefinable for companies whether large or small. And yet, they still offer various trends to minimize costs, and this includes budgeting.

Litigation budget, are funds to finance and support litigation. It provides a cost estimate that is valuable in reducing costs. Nonetheless, if the budget does not focus merely on the steps to achieve an acceptable settlement, it will not help for the immediate resolution of the case.

Say for instance, the budgets have an allotment for specific amounts such as payment for attorney’s fees. If there are projected figures, the counsel may tend to over-estimate it to protect his fees. This only pushes the budget away from its goal toward a protective device.

Litigator on Setting Litigation Budgets

The litigator may foresee litigation expenses if he will speak up on cost-efficient strategies and solutions. Nevertheless, if the client is more concerned to the total cost of the legal representation or to the total cost of litigation, it is not constructive to allocate costs.

Additionally, if the litigation budgets are drafted by a litigator without the partaking of the client or the corporate counsel, the goal to reduce litigation cost will be of no use.

It is imperative though, that there must be a direct connection amongst the client’s litigation goals and the planning and projected cost of litigation. If however, the client persists to settle for an amount before the commencement of litigation, the litigation budget must reflect that plan for the litigation.

On the contrary, if the budget does not reflect to the business objectives of the client, and if the foreseeable litigation cost is not accurate, this may not lead to the attainment of client’s goals.

Projecting litigation costs is an important part of litigation planning. Thus, careful planning correlated by clients and corporate counsel is a prime consideration to reduce the costs.
