Labor Laws
Labor law is comprised a set of statutes and regulations that govern employers and industries on labor and working conditions of employees. Labor law also determines the rights and obligations that arise out of an employment contract, and begins when an offer for employment is made by an employer to an employee.
Labor law regulates the entire relationship between employer and employee - the initial hiring process, job duties, wages, promotions, benefits, employment reviews and termination of the employment relationship. It also includes litigation on the basis of unfair labor practices and discrimination.
California has one of the most stringent and protective labor laws in the United States. Though many new laws and statutes have been passed recently, California labor law basically deals with the following issues:
- Violation of Overtime laws
- Issues on overtime-exempt employees
- Alternative work schedules
- Meal and rest break periods
- Work safety and conditions
Labor law issues may involve understanding of the complex rules and statutes and employer policies that govern the employer-employee relationship.
Issues and disputes may arise out of a misunderstanding or violation of these various regulations and statutes in areas such as hiring, wages, promotion, meal and rest periods, benefits, and work termination, among others.
