EMPLOYMENT LAW: EEOC Sues Innershore Enterprise for HIV Disability Discrimination Charge
November 22, 2010
Baltimore - The federal Equal Employment Opportunity Commission (EEOC) has filed a discrimination lawsuit on Monday against Innershore Enterprise Inc.-Marlow 6 Theater for firing a HIV-positive manager.
Reports said the Temple Hills administration fired Robins Adams after learning of her Human Immunodeficiency Virus (HIV) illness. Adams reported the motive for the termination of employment contract to EEOC wherein the formal lawsuit was filed.
EEOC said that the Americans with Disabilities Act (ADA) prohibits wrongful termination on the basis of disability, perceived disability, or medical condition.
Innershore Enterprise Inc. will face penalties such as compliance to ADA regulations, mandatory training for administration and employees, and adherence to 5-year disciplinary program.
EEOC has also required Innershore to give monetary relief to Adams as damages.
EEOC asserted that the suit serves as a reminder for employers to dispel myths on HIV and prohibit discrimination on the basis of medical condition or disability.
Innershore Enterprise has agreed to comply with the conditions of EEOC.
