EMPLOYMENT DISCRIMINATION: EEOC files Race Discrimination Suit against CSX Railroad Company

Louisville, Kentucky – A race discrimination suit has been filed by the Equal Employment Opportunity Commission (EEOC) against a Jacksonville, Florida- based railroad company in behalf of an African-American employee.
The lawsuit was filed against CSX transportation after they terminated Edward Gay, an African- American conductor, for an admitted operating violation and was refused leniency reinstatement despite giving leniency reinstatement to white conductors who committed more egregious violations than him.
The lawsuit also alleges that reinstated white employees were allowed to return to work after 45 days while it took nearly two years before Gay was finally reinstated last April 2010.
The EEOC is seeking back pay with compensatory and punitive damages for Gay.
