EMPLOYMENT LAW: Court Denies Ordering Back Pay of California Furloughed Workers

Alameda - An Alameda County judge has spared California from immediately providing hundreds of millions of dollars as back pay to state workers in around 70 departments who were previously required to take furlough days.
According to reports, Judge Frank Roesch did not order the state to provide immediate back pay to state furloughed workers due to Gov. Arnold Schwarzenegger’s pending appeal.
Roesch also ordered the removal of furlough days affecting an estimated number of 70,000-75,000 state workers.
The judge’s recent decision supported his Dec. 31 ruling that the governor should not have required these employees to take furlough days because they are working in departments that are not entirely funded by California.
