EMPLOYMENT LAW: Apparel Retailer Settles Disability Discrimination with $38,000

June 16, 2011

Indianapolis-- Retailer Finish Line Inc. has agreed to pay $38,000 as settlement for a disability discrimination lawsuit, a statement from the Equal Employment Opportunity Commission said.

Finish Line, an athletic apparel retailer, assented to pay damages to Emma Armon who filed a discrimination complaint with the EEOC.

According to EEOC reports on Thursday, Emma Armon reported Finish Line's refusal to transfer her to Customer Service Representative (CSR) position as part of accommodation for her right shoulder injury. Her employer then instructed her to remain as a warehouse worker though qualified as a CSR.

The EEOC initiated conciliation and Finish Line agreed to pay Armon $38,000 as a settlement sum. The employer also assented to correct its policies, conduct anti-discrimination seminar, and post EEOC notices.
